Steps to Take Before Filing for Bankruptcy
Filing for bankruptcy is not easy, and since Congress passed the Bankruptcy Abuse Prevention and Consumer Protection Act in 2005, it has become more difficult than it used to be. A small mistake can cause a delay or even disqualify you from filing for bankruptcy. It is best to make sure everything is done right the first time.
To help you avoid a potentially disastrous mistake, here is a brief rundown of what steps you'll have to take if you file for bankruptcy with The Cummings Law Firm, P.A.:
- Call (704)512-0697 or contact us online to schedule a free initial consultation. Gather information about your debts, your creditors, your income, your assets, your property, your identity and your marital relationships. For a detailed checklist of the information we will need, click here.
- Obtain a recent copy of your credit report. You can find your credit report by clicking here.
- Bring in any missing information for a second meeting at The Cummings Law Firm, P.A., and we'll review the client worksheet. We also will contract with you to provide legal service for the life of the bankruptcy.
- Schedule credit counseling sessions with one of the 15 court-approved credit counseling agencies in Charlotte. The law requires that you take these courses before your bankruptcy is settled.
- Our next meeting is to sign your papers and make any changes in the information provided at this session; we will file your bankruptcy electronically. For some insight into what comes next, see our page "What Happens in a Bankruptcy Proceeding?"
